Introduction These Terms and Conditions ("Terms") govern your access to and use of all courses, content, and services provided by Kwoon ("we," "us," or "our"), including those led by individual instructors or course teachers. By purchasing or accessing any course, you agree to these Terms in full. If you do not agree to these Terms, please do not use our services.
1. License and access
1.1. When you purchase a course, you are granted a non-exclusive, non-transferable, and non-sublicensable license to access the specific course content for your personal, non-commercial use.
1.2. You may not share your login credentials or account access with others. Sharing your password or account details will result in the immediate termination of your access without a refund.
1.3. Your access is currently limited to the course(s) you have purchased. If broader subscription options (e.g., a monthly pass to access all courses) are introduced in the future, these will be governed by additional terms and conditions.
2. Refund policy
2.1. We offer a 14-day refund policy from the date of purchase. If you are not satisfied with your course, you may request a refund during this period, provided you have not accessed or downloaded substantial portions of the course content.
2.2. Refund requests should be submitted via email to [email protected], including your name, order details, and reason for the request.
3. Duration of access
3.1. When you purchase a course, you are granted lifetime access to the content for that specific course.
3.2. Future subscription offerings may allow access to multiple courses on a recurring basis. If you opt for such a subscription in the future, additional terms and conditions will apply.
4. Updates and new content
4.1. We may update or add new content to courses you have purchased. Access to such updates will be provided at no additional cost if they are part of the same course.
4.2. New, separate courses may be offered in the future and will require additional purchases.
5. Testimonials and feedback
5.1. By providing testimonials or feedback about our courses, you grant Kwoon a perpetual, royalty-free license to use, reproduce, and publish your testimonial in marketing materials, including on our website and social media channels.
5.2. If you do not wish for your testimonial to be used, you must notify us in writing at the time of submission.
6. Prohibited activities
6.1. You may not copy, distribute, screen record, reproduce, or share course content in any way, whether for personal, commercial, or public use.
6.2. Sharing login credentials or allowing others to access your account is strictly prohibited and will result in the immediate termination of your access without a refund.
7. Disclaimer of risks and liability
7.1. Participating in any martial art, exercise, or well-being activity involves inherent risks, including the risk of injury, illness, or, in rare cases, death. By participating in any course offered by Kwoon or its instructors, you acknowledge and accept these risks and agree to follow all safety instructions provided.
7.2. You must take personal responsibility for your decision to participate and conduct yourself responsibly. This includes ensuring the safety of others, including participants, third-party helpers, and the general public.
7.3. Kwoon, its instructors, and affiliates (collectively, "the Kwoon") accept no liability for any injury, loss, or damage arising from your participation, except where such injury, loss, or damage is caused by the negligence of the Kwoon. Nothing in these Terms excludes liability for death or personal injury caused by negligence or for any other liability that cannot be excluded under UK law.
8. Complaints procedure
8.1. If you have a complaint, please contact us at [email protected] with details of your issue.
8.2. We will acknowledge your complaint within 2 working days and aim to provide a resolution within 10 working days.
8.3. If you are dissatisfied with our response, your complaint may be escalated internally for further review. For disputes that cannot be resolved, you agree to mediation as the final step, which we will arrange through a neutral third-party provider.
9. Intellectual property
9.1. All course content, including videos, materials, and associated intellectual property, is owned by Kwoon or its instructors. You may not use this content except as permitted under these Terms.
9.2. Any unauthorised use of course materials, including redistribution or public sharing, is strictly prohibited and may result in legal action.
10. Governing law and jurisdiction
10.1. These Terms are governed by and construed in accordance with the laws of England and Wales.
10.2. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the English courts.
11. Changes to these Terms
11.1. We reserve the right to update these Terms from time to time. The most current version will always be available on our website.
11.2. Continued use of our services after any changes constitutes acceptance of the updated Terms.
